We are a nation of laws.
The underlying foundation of our laws are the rules written down in the Constitution and Bill of Rights.
These 2 documents outline what is and what is not permissible when it comes to laws.
If we have laws that violate the constitution even though those laws may appear to be "sensible" the enactment and the enforcement of those laws mean that we are operating outside of the Constitution.

In short because we have a Constitution it means that there will be some risk associated with people having rights.
What is a Right? A Right is a Limitation of Government power.

There are 2 Amendments in the Bill of Rights which mention the phrase "Due Process". Before a right can be taken away there must be "Due Process".

Just as before we lock a person up for breaking the law: that person must have a fair trial before a jury of his peers. This is part of "Due Process".
